By accessing or using Kudosey, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform. These terms apply to all visitors, buyers, and sellers on Kudosey.
Kudosey is an online marketplace focused on virtual world content, connecting independent creators ("Sellers") with buyers ("Users"). Kudosey acts as the merchant of record for all transactions, handling payment processing and the collection and remittance of applicable sales tax and VAT where required by law via Stripe Tax — it does not produce, own, or control the content listed by Sellers.
These Terms of Service ("Terms") govern your access to and use of the Kudosey website, services, and marketplace (collectively, the "Platform"). By creating an account or making a purchase, you enter into a legally binding agreement with Kudosey.
To access certain features of the Platform — including purchasing, messaging, and saving listings — you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You must be at least 13 years of age to create an account on Kudosey. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian to use the Platform, and that your parent or guardian has reviewed and agrees to these Terms on your behalf. Users under 13 are not permitted to use the Platform under any circumstances.
NSFW Content Access. Access to mature and adult-themed content (tagged "NSFW") is disabled by default for all accounts. To enable NSFW access, you must provide your date of birth in your account settings. Your date of birth is permanent and may only be changed by contacting support@kudosey.com. By enabling NSFW access, you certify that you are 18 years of age or older and that it is lawful for you to access such content in your jurisdiction.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@kudosey.com if you suspect any unauthorized access to your account. Kudosey is not liable for any loss or damage arising from your failure to keep your credentials secure.
Each person may maintain only one active account. Creating multiple accounts to circumvent suspensions, bans, or platform limits is prohibited and will result in permanent termination of all associated accounts.
You may close your account at any time by contacting support@kudosey.com. Closing your account does not entitle you to a refund of any purchases. Any pending or active orders must be resolved before account closure.
By creating an account, you consent to receive electronic communications from Kudosey, including emails and in-platform notifications. You agree that any notices, agreements, disclosures, or other communications we send to you electronically satisfy any legal requirement that such communications be in writing. This consent is required to use the Platform.
By using Kudosey, you agree to use the Platform only for lawful purposes and in accordance with these Terms. The following conduct is strictly prohibited:
Violations may result in immediate suspension or permanent termination of your account, forfeiture of any pending orders, and where applicable, legal action.
All prices on Kudosey are displayed in US Dollars (USD) unless otherwise stated. Kudosey acts as the merchant of record for all transactions. Payments are processed securely through Stripe. By completing a purchase, you authorize Kudosey to charge the payment method associated with your account for the listed amount plus applicable fees. Kudosey collects and remits applicable sales taxes on all transactions.
A non-refundable processing fee of $0.30 is added to every transaction and is displayed at checkout. All sales are final. Please review our Refund Policy for details on disputes and exceptions.
Purchasing NSFW-tagged listings requires age verification via the NSFW toggle in your account settings. You must be 18 years of age or older to enable this toggle. By purchasing mature content, you confirm that NSFW access is enabled on your account and that it is lawful for you to access such content in your jurisdiction. See Section 2.1 for details on how NSFW access is enabled.
Kudosey reserves the right to refuse or cancel any transaction that appears fraudulent or suspicious. We may require additional verification for certain transactions. Multiple failed payment attempts may result in account suspension. Use of stolen or unauthorized payment methods will result in immediate account termination and may be referred to law enforcement.
Kudosey is a marketplace platform. Sellers are independent third parties, not employees or agents of Kudosey. While Kudosey acts as merchant of record for payment purposes, Kudosey does not create, endorse, verify, or guarantee any content, listing, or service offered by Sellers.
Kudosey is not responsible for the quality, accuracy, safety, legality, or availability of any item listed on the Platform. Any disputes regarding a purchase should be directed to the Seller in the first instance. If you cannot resolve a dispute with a Seller, please contact support@kudosey.com.
Sellers who use artificial intelligence or machine learning tools in creating their content are required to clearly disclose this in their listing descriptions using the designated AI label. Kudosey does not warrant the accuracy, originality, or legal compliance of AI-generated content. Sellers remain solely liable for all AI-generated content they list.
You may not use any content, data, or materials accessed through Kudosey — including but not limited to listings, previews, descriptions, user-generated content, or any other platform data — to train, develop, fine-tune, or improve any machine learning model, artificial intelligence system, or similar technology without Kudosey's prior written consent. This prohibition applies regardless of whether the content was purchased or accessed for free.

All content on the Kudosey Platform — including its design, logo, branding, code, and editorial content — is owned by or licensed to Kudosey and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Kudosey's proprietary content without written permission.
Content sold by Sellers remains the intellectual property of the respective Seller. Purchasing a listing grants you a personal, non-exclusive, non-transferable license to use the content for its intended purpose unless the Seller's listing specifies otherwise. No ownership of the underlying IP is transferred through a purchase.
Kudosey respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Platform infringes your copyright, please send a notice to our designated DMCA agent at dmca@kudosey.com with the following information: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the infringing material and its location on the Platform; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.
Repeat infringers will have their accounts terminated. Users who submit false or bad-faith DMCA notices may face account penalties and legal liability.
Important — Please Read
This section limits Kudosey's legal liability to you. It is an important part of the basis of the bargain between you and Kudosey.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Kudosey expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Kudosey does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, Kudosey and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from your use of or inability to use the Platform, any content purchased through the Platform, or any unauthorized access to or alteration of your account.
In no event shall Kudosey's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the greater of (a) the total amount you paid to Kudosey in the twelve (12) months preceding the claim, or (b) $100.00 USD.
You agree to indemnify and hold harmless Kudosey and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights, including intellectual property rights.
Kudosey shall not be liable for any delay or failure to perform any obligation under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, pandemics, internet or telecommunications failures, cyberattacks, third-party service failures (including payment processors), or new laws or regulations affecting the Platform. During any such event, affected obligations will be suspended. If a force majeure event continues for more than thirty (30) consecutive days, either party may terminate affected services upon written notice.
Before filing any formal claim, you agree to contact Kudosey at support@kudosey.com and attempt to resolve the dispute informally. Most concerns can be resolved quickly this way. You agree to give Kudosey at least 30 days to respond and attempt resolution before pursuing any formal proceedings.
If a dispute cannot be resolved informally, you and Kudosey agree that it will be resolved by final and binding individual arbitration rather than in court, except where prohibited by law. The arbitration will be conducted in English under the rules of the American Arbitration Association (AAA), and shall take place in Texas. Each party will bear its own costs unless the arbitrator determines otherwise.
Class action waiver: You and Kudosey agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. For matters not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Texas.
Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm pending arbitration.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Kudosey, you consent to the collection and use of your information as described in our Privacy Policy.
Kudosey reserves the right to update or modify these Terms at any time. We will notify you of material changes via email and in-platform announcements at least 7 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the Platform before the effective date of the changes. If you have any questions, please contact us at support@kudosey.com.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision. You may not assign your rights or obligations under these Terms without our prior written consent. These Terms constitute the entire agreement between you and Kudosey with respect to your use of the Platform and supersede all prior agreements.
